With this Privacy and Cookies Policy, FILBAK BRANDING ESPACIAL S.L. (hereinafter referred to as “FILBAK”) aims to demonstrate its commitment to compliance and meet the requirements imposed by European Union Regulation 2016/679, concerning the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), as well as by Organic Law 3/2018, on the Protection of Personal Data and guarantee of digital rights.

The Privacy and Cookies Policy is an integral part of the Legal Notice.

The Data Controller, i.e., the legal entity that determines the purposes and means of processing your personal data, is FILBAK BRANDING ESPACIAL S.L. with VAT number B05436019 and registered address at Calle La Gitanilla, 17, office 14, 29004 (Málaga).

PURPOSE OF PROCESSING

The purpose of each of the treatments carried out by FILBAK will depend on the type of personal data being processed.

Regarding the personal data of customers or potential customers that have been provided to us, the processing of such data will be aimed at (1) responding to the query posed, including offering our services; (2) managing the contractual relationship that may be established with FILBAK; (3) sending advertising about our products or services, or other relevant news or information; and (4) complying with tax, accounting, or any other legal obligations imposed on FILBAK.

The provided data will be kept until the data subject exercises their right to deletion, in accordance with the provisions of the “Rights” Clause of this Privacy and Cookies Policy, or, where applicable, for the period of time established by the applicable regulations. In the particular case of data necessary to fulfill our tax and accounting obligations, said data will be kept for a minimum of 6 years, as this is the retention period required by Article 30 of the Spanish Commercial Code.

The contact form included on the website identified with the domain name www.filbak.com (the “Portal”), or the contact details that may be found on the Portal, are not intended for the submission of resumes or any other personal data by individuals interested in working at FILBAK. Therefore, unless FILBAK, in the particular case, indicates otherwise, the personal data received through this means will be immediately destroyed.

LEGITIMACY

All personal data processing carried out by FILBAK is justified by one or more of the legal bases contemplated in the regulations.

The processing of personal data of our customers or potential customers is justified by (i) the express consent provided by the data subject themselves; (ii) the need to carry out the processing so that the contract for work or provision of services signed can be executed, as well as to apply the pre-contractual measures that are necessary; and (iii) the need to comply with any tax, accounting, or other legal obligations imposed by the current legal system.

Note that if there is a legal basis other than consent, such legal basis would justify the processing on its own, and consent would not be necessary.

Regarding the personal data requested in the contact form included on the Portal, it will be mandatory to provide a name and an email address, as these are the minimum necessary data to respond to the questions posed to FILBAK. In the event that this data is not provided, FILBAK may not be able to respond to the questions raised.

RECIPIENTS

No provision is made for any transfer or international transfer of your personal data.

RIGHTS

The data subject, i.e., the individual to whom the data refers, is entitled to the rights provided for in the current regulations on data protection, to the extent and under the conditions established therein. These rights are as follows:
